In a country like India, female labour participation rates in the economy are exceptionally low. Keeping this in mind, it is possible that certain companies have no women employees. In such a case, the company still needs to nominate a PoSH Internal Committee (IC).
Nominating a presiding officer
In the absence of a woman employee, the company can nominate their IC’s Presiding Officer from a branch or administrative unit of the company. This branch/unit can be located elsewhere. The company can also nominate women employees from any other workplace under the same employer.
Nominating an external member
Every IC also has to have an external member. This is typically someone familiar with issues relating to sexual harassment. They could be from a non-governmental organisation or an association committed to the cause of women. To ensure that the IC has at least 50% women, the external member can be a woman.
Examples of all-male companies with PoSH ICs
TATA Power has two internal committees: Noida IC for their Noida branch, and SED Delhi). At Nestle India, their Presiding Officer in Delhi also serves on their Gurgaon IC. Similarly, CIS India has the same presiding officer for their branches in Delhi and Bangalore). Godrej, Boyce and Cafe Coffee Day follow the same example.
